The bill gives a definite procedure and allows the COMELEC to define rules and regulations to give teeth to the power of initiative. Transcending such changes in the exercise of legislative power is the declaration in the Philippine Constitution that he Philippines is a Republican State where sovereignty resides in the people and all government authority emanates from them. Let us reexamine the validity of the view of the six justices that R.A. 6735 is insufficient to implement Section 2, Article XVII of the 1987 Constitution allowing amendments to the Constitution to be directly proposed by the people through initiative. This Commission is not unmindful of the transcendental importance of the right of the people under a system of initiative. However, neither can we turn a blind eye to the pronouncement of the High Court that in the absence of a valid enabling law, this stole my deposit right of the people remains nothing but an «empty right», and that this Commission is permanently enjoined from entertaining or taking cognizance of any petition for initiative on amendments to the Constitution. The afore-quoted provision of the Constitution being a non self-executory provision needed an enabling law for its implementation. Thus, in order to breathe life into the constitutional right of the people under a system of initiative to directly propose, enact, approve or reject, in whole or in part, the Constitution, laws, ordinances, or resolution, Congress enacted Republic Act No. 6735. Thereafter, the Vice President, as Member of Parliament, shall immediately convene the Parliament and shall initially preside over its session for the purpose of electing the Prime Minister, who shall be elected by a majority vote of all its members, from among themselves.

Wherein this Court ruled that the failure to join an indispensable party does not divest the court of jurisdiction. X x x the Order dated June 24, 2002 was apparently the result of agreements between petitioners and Antonio Osmeña. A close reading of the petition filed by respondent Tayud Golf distinctly indicates that the grounds relied upon were based on extrinsic fraud and lack of jurisdiction. – The action shall be commenced by filing a verified petition alleging therein with particularity the facts and the law relied upon for annulment, as well as those supporting the petitioner’s good and substantial cause of action or defense, as the case may be. What the petitioners fail to state, in simple terms, is that the assailed Orders and Writ would not have come into fruition if not for their original complaint, which sought to nullify the Affidavit of Quitclaim and Waiver. Based on the above premise, the CA correctly ruled that respondent Tayud Golf was an indispensable party to the original action. A close of examination of the CA’s decision and the basis of its conclusions render the above argument of petitioners without any merit. The petition shall raise only questions of law which must be distinctly set forth.

He said that city officials should do their best to make their respective cities self-sufficient in their income. A delegation from the Leyte Chamber of Commerce presented a petition signed by thousands of residents of Tacloban City requesting the reduction of electricity rates in the city. The group was accompanied by former Commerce Secretary Cornelio Balmaceda. A delegation of farmers from Tayug, Pangasinan, sought the President’s assistance in the enforcement of a Supreme Court ruling returning to them 300 hectares of rice lands allegedly taken away from them by the Hacienda Lichauco. The President immediately ordered the director of lands to look into the matter and to implement the reported decision of the high tribunal. The President emphasized to Crisol that the people’s rights and liberties should be scrupulously respected. He said the battle against the Communists should never be fought at the sacrifice and expense of democracy.

Upon completion of the verification process, the respective local election officers issued certifications to attest that the signature sheets have been verified. The verified signature sheets were subsequently transmitted to the office of Sigaw ng Bayan for the counting of the signatures. The signature sheets were distributed nationwide to affiliated non-government organizations and volunteers of Sigaw ng Bayan, as well as to the local officials. Copies of the draft petition for initiative containing the proposition were also circulated to the local officials and multi-sectoral groups. We feel, however, that the system of initiative to propose amendments to the Constitution should no longer be kept in the cold; it should be given flesh and blood, energy and strength. Congress should not tarry any longer in complying with the constitutional mandate to provide for the implementation of the right of the people under that system. Pending resolution of the case, the Court issued a temporary restraining order enjoining the COMELEC from proceeding with the Delfin Petition and the Pedrosas from conducting a signature drive for people’s initiative to amend the Constitution. A petition for an initiative on the 1987 Constitution must have at least twelve per centum (12%) of the total number of registered voters as signatories, of which every legislative district must be represented by at least three per centum (3%) of the registered voters therein. This Court cannot betray its primordial duty to defend and protect the Constitution.
- The meeting, which was held beneath a temporary shed roofed with coconut palms, was the third out-of-Malacañang Cabinet meeting during this Administration, inspired by its desire to enable high government officials to know the actual needs of the people in the barrios.
- The framers of the Constitution intended to give the people the power to propose amendments and the people themselves are now giving vibrant life to this constitutional provision.
- In other words, the judiciary is the final arbiter on the question whether or not a branch of government or any of its officials has acted without jurisdiction or in excess of jurisdiction, or so capriciously as to constitute an abuse of discretion amounting to excess of jurisdiction or lack of jurisdiction.
- Without the Declaration of Pledge, petitioner Citibank had no authority to demand the remittance of respondent’s dollar accounts with Citibank-Geneva and to apply them to her outstanding loans.
- Other than the petitions, this Court also received Motions for Intervention from among others, Sen. Aquilino Pimentel, Jr., and Special Appearances by House Speaker Jose C.
- As applied to fundamental law, such as a constitution or charter, it suggests a convention to examine the whole subject and to prepare and submit a new instrument whether the desired changes from the old are few or many.
Thus arose the instant petitions against the House of Representatives, et. Al., most of which petitions contend that the filing of the second impeachment complaint is unconstitutional as it violates the provision of Section 5 of Article XI of the Constitution that «o impeachment proceedings shall be initiated against the same official more than once within a period of one year.» There can be no constitutional crisis arising from a conflict, no matter how passionate and seemingly irreconcilable it may appear to be, over the determination by the independent branches of government of the nature, scope and extent of their respective constitutional powers where the Constitution itself provides for the means and bases for its resolution. “To repeat, no other entity or official of the government, not the prosecution or investigation service of any other branch, not any functionary thereof, has competence to review a judicial order or decision – whether final and executory or not – and pronounce it erroneous so as to lay the basis for a criminal or administrative complaint for rendering an unjust judgment or order. Is the President’s power to call out the armed forces as their Commander-in-Chief in order to prevent or suppress lawless violence, invasion or rebellion subject to judicial review, or is it a political question? Benipayo reassigned petitioner from the EID, where she was Acting Director, to the Law Department, where she was placed on detail. Respondents claim that the reassignment was “pursuant to x x x Benipayo’s authority as Chairman of the Commission on Elections, and as the Commission’s Chief Executive Officer.” Evidently, respondents’ anchor the legality of petitioner’s reassignment on Benipayo’s authority as Chairman of the COMELEC. The real issue then turns on whether or not Benipayo is the lawful Chairman of the COMELEC.
